These Terms of Use explain the terms on which Pink Elephant, Unipessoal Lda, NIPC 519056582, operating Mirari, provides the Mirari website, the Foundation Program and the Mirari practitioner community. By accessing or using the Mirari website, applying to or enrolling in the Foundation Program, or joining the practitioner community, you agree to these Terms of Use. If you do not agree, you should not use the website or the services described in these Terms.
Mirari is an education and professional-community platform for psychedelic-assisted practice, offering the Foundation Program and a practitioner community for coaches, therapists, integration specialists and related professionals across Europe.
These Terms of Use apply to website visitors, applicants, enrolled students, alumni, community members and subscribers, and any other person who accesses or uses the Mirari website or services.

2. Acceptance of these Terms
By accessing or using the Mirari website, applying to or enrolling in the Foundation Program, or joining the practitioner community, you accept and agree to be bound by these Terms of Use. If you are entering into these Terms on behalf of an organization, you confirm that you have authority to bind that organization.
3. Eligibility
You must be at least 18 years old to use the Mirari website, apply to the Foundation Program, or join the practitioner community. You do not need to be a licensed clinician to apply to the Foundation Program. Mirari expects applicants to bring maturity, self-awareness and a genuine commitment to responsible engagement with the program’s subject matter. Mirari may decline an application, or suspend or terminate access, where these expectations are not met.
4. The services
Mirari provides an informational website, the Foundation Program, a 12-week online cohort-based training program, and the Mirari practitioner community, a membership platform for peer discussion, resource sharing and professional networking hosted on Circle. Program format, schedule, fees and content are described on the website and may be updated between cohorts.
5. Educational purpose
Mirari’s website, the Foundation Program and the practitioner community are provided for educational and informational purposes only. They are not intended to be a substitute for professional medical advice, diagnosis or treatment, and nothing on the website or in the program constitutes medical, clinical, legal or regulatory advice. You should not rely on Mirari’s content as a substitute for advice from a qualified professional in the relevant field, and you remain solely responsible for complying with the laws applicable to you, including any laws governing controlled substances, in your own jurisdiction. Mirari does not supply, administer, facilitate access to, or encourage the use of any controlled substance.
6. Certification and scope of practice
Completing the Foundation Program results in a certificate of completion. Completion does not, by itself, qualify you as a psychedelic therapist, authorize you to provide clinical, therapeutic or medical services, or permit you to offer psychedelic guiding or facilitation services to clients. Any professional practice arising from, or associated with, the subject matter of the program remains subject to the licensing, regulatory and legal requirements applicable in your jurisdiction, which you are responsible for identifying and meeting. The Foundation Program is not a clinical training program and does not itself confer clinical qualification.
7. Account registration
Access to the Foundation Program and the practitioner community is provided through an account on Circle, Mirari’s learning management and community platform. You must provide accurate registration information, keep your login credentials confidential, and notify Mirari promptly of any unauthorized use of your account. You are responsible for activity that occurs under your account.
8. Enrolment, fees and payment
The current Foundation Program fee, any early-bird discount, and scholarship availability are stated on the website at the time of application. The fee and any discount period are subject to change for future cohorts. Payment is processed by Stripe, and flexible payment plans may be available via Klarna depending on your jurisdiction and eligibility. Mirari does not process or store your card details. Scholarship applications are reviewed on the timeline stated on the website. Your place in a cohort is confirmed only once payment, or the applicable scholarship award, has been processed.
9. Right of withdrawal, cancellation and refunds
If you are a consumer contracting with Mirari at a distance, you have a statutory right of withdrawal under the Portuguese distance-contracts regime (Decree-Law No. 24/2014 of 14 February, implementing Directive 2011/83/EU), which you may exercise within 14 days of the date your enrolment contract is concluded, without giving any reason. Because the Foundation Program is a service delivered over the 12-week cohort period, you may lose this statutory right, in accordance with that regime, once delivery of the program has begun with your prior express request and acknowledgement that you will lose the right of withdrawal on full performance.
Separately from the statutory right, Mirari’s program-specific refund policy, as stated on the website, allows a partial or full refund if you withdraw before the program begins. Once the program has started, refunds become limited because your place in the cohort, faculty access and learning resources have already been allocated. 10. Changes, postponement or cancellation by Mirari
Mirari may reschedule or postpone a cohort of the Foundation Program, for example where minimum enrolment is not reached or a facilitator becomes unavailable, and in limited circumstances may cancel a cohort. Where Mirari cancels a cohort you are enrolled in, you will be offered a full refund or a place in a subsequent cohort.
11. Practitioner community and acceptable use
The Mirari practitioner community is intended for professional, respectful peer engagement. You agree not to post or share client-identifying information or client case details, harass or discriminate against other members, misrepresent your professional qualifications, promote or facilitate the unlawful acquisition or use of controlled substances, or use the community for unrelated commercial solicitation. Mirari may remove content, and suspend or terminate a member’s access, where this section is breached or the community is otherwise misused.
12. Intellectual property
The Mirari website, curriculum, course materials, recordings and related content are owned by Pink Elephant, Unipessoal Lda or its licensors and are protected by copyright and other intellectual property laws. Enrolment in the Foundation Program grants you a personal, non-exclusive, non-transferable license to access and use program materials for your own learning. You may not reproduce, distribute, publicly perform, or create derivative works from program materials, or make them available to anyone who is not enrolled, without Mirari’s prior written consent.
Content you post in the practitioner community remains yours, but by posting it you grant Mirari a non-exclusive, royalty-free license to host, display and distribute it within the community for the purposes for which the community is operated.
13. Third-party services
Mirari’s website and program delivery rely on third-party services, including Circle for the learning platform and community, Zoom for live sessions, and Stripe and Klarna for payment processing. Your use of these services is also subject to their own terms and privacy policies, which Mirari does not control.
14. Disclaimers and limitation of liability
The Mirari website and program materials are provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, Mirari disclaims all warranties, express or implied, regarding the website and program, including as to accuracy, completeness, or fitness for a particular purpose.
To the fullest extent permitted by applicable law, Mirari’s liability for any claim arising out of or relating to these Terms or your use of the website or program is limited to the amount you paid to Mirari in the twelve months before the claim arose. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud.
15. Indemnification
You agree to indemnify Mirari against claims, losses or expenses arising from your breach of these Terms or your misuse of the website, the program, or the practitioner community, except to the extent caused by Mirari’s own breach or negligence.
16. Suspension and termination
Mirari may suspend or terminate your access to the website, the program, or the practitioner community if you breach these Terms, including the acceptable-use provisions in section 11. You may stop using the website, or withdraw from the program or community, at any time, subject to the enrolment, fee and refund terms in sections 8 and 9.
17. Governing law and disputes
These Terms are governed by Portuguese law. Any dispute arising out of or relating to these Terms, or your use of the website or program, is subject to the jurisdiction of the Portuguese courts, without prejudice to any mandatory consumer-protection rules that entitle you, if you are a consumer, to bring proceedings in the courts of your own country of habitual residence. If you are a consumer resident in Portugal, you may also refer a dispute to the Direção-Geral do Consumidor or another competent Portuguese consumer arbitration center.
18. Changes to these Terms
Mirari may update these Terms of Use from time to time. If material changes are made, Mirari will provide notice in an appropriate manner. Continued use of the website, the program, or the practitioner community after changes take effect constitutes acceptance of the updated Terms.
